Terms of Service

By paying for the invoice, the client (commissioner) AUTOMATICALLY ACCEPTS ALL TERMS AND CONDITIONS stated on this page. After accepting, the client is obligated to follow ANY OF THE STATEMENTS displayed on this page. Before paying, please read the terms of service with discretion.

All sensitive information (like contact info and other personal details) shared between the client and the artist are STRICTLY CONFIDENTIAL and will not be shared to anybody including third parties.
Under any circumstances, the client is not authorized to use any portion of the commissioned illustration for Non-Fungible Tokens or any other form of cryptocurrency.
The client will only be granted permissions stated by their commercial use: The higher the degree of the commercial use, the broader their options.
All interactions between the artist and the client are only limited to the commissioned illustrations. The artist has rights to block the commissioner if they choose to violate this mandate multiple times. The artist will not be obligated to warn the client for this matter.

❀ COMMERCIAL USE ❀

For Commercial Use, the client is obligated to pay more than the original price depending on the purpose of the commissioned illustration:

Personal Non-Commercial - 100% of the Original Price. Basically no additional charges.

examples (Profile Photo, Profile Banner Photo, Wallpaper)

Monetized Platforms - 200% of the Original Price. The client is required to pay 2 times the original price.

examples (Twitch TV, YouTube, Patreon)

Small Business - 300% of the Original Price. The client is required to pay 3 times the original price.

examples (Merchandise). By paying 300% of the original price, the client is allowed to use their commissioned illustration for up to small businesses like merch.

The category itself is how much authority the client could get through their commissioned illustration/s accordingly.

❀ PAYMENT ❀

Payment option available is only PayPal
The invoice will be sent to the client through email after the whole concept of their requested commission has been discussed, clarified and elaborated.
FULL-PAYMENT REQUIRED before the request will be sketched.
The artist is permitted to decline a commission request, whether they or they won't let the client know the reason behind the decline.
NO REFUNDS OFFERED.

❀ ORDERING, WORKTIME, AND DEADLINES ❀

Ordering

There are limited commission slots. These slots are QUEUE-BASED; FIRST COME, FIRST SERVE.
The artist will only accept commission requests submitted on their website.
Commission requests are only limited to digital illustrations
The artist will start doing the sketch of the request right after the client does full payment.

Worktime

After the payment, the client will be sent a draft/sketch/layout of the project. Depending on the complexity and other circumstances, the client can expect the draft to be delivered to them within the day on most cases.
Usual Estimated Time when creating an illustration takes a week. Depending on the complexity and difficulty of the request, it may take up to 30 days for one commission to a few months.

Deadlines

Commissioned works with deadlines will have additional charges due to it being prioritized more than those without any deadlines. On certain circumstances, the commissioned illustration would also take more time of the artist’s time for every day they work on it, thus the additional charges.
A note to deadlines that AT THE MOMENT, I won't accept any commissions with a very strict schedule. The client will be notified about such.

❀ REQUESTING REVISIONS ❀

At any time during the process, the client may request the WIP (Work-in-Progress) of the project. At the same time, the client may request changes they wish to be added or corrected on the commissioned illustration. Feel free to contact the artist any time.
The final price may vary depending on the adjustments requested by the commissioner regarding the illustration. Basic Adjustments like color changes are free. Adjustments, like outfit, hair, poses, or anything else that would require the artist to change a lot of the elements would require additional payment.
Depending on how much change the requested correction/s will do to the illustration, the artist has the right to decline the request. The client will only be able to request revisions THRICE.
After the commissioned illustration has been agreed on by both the client and the artist to be finalized, there will be no more opportunities for the client and artist to further revise the illustration.

❀ COPYRIGHT & USAGE POLICY ❀

As an artist, I hold every right to:

Publish my commissioned illustrations on any of my own platforms.
Use any portion of the progress of making the illustration for promoting myself.

As a Personal Non-Commercial Use Commissioner, you may:

Upload / post the art at any other non-profitable platform with proper credit to my site or social media accounts (e.g., Twitter: @IchinoIchinoseArt)
Print the art or make any merchandise for your personal use that is NOT FOR SALE.
Use the art for your own profile photo, banner photo, etc., as long it is not monetized or profiting.

You are NOT ALLOWED to:

Redistribute, reproduce, repost, make merchandise of, or otherwise profit from the commissioned artwork regardless of the form of currency involved.
Post the full-size illustration publicly. You can post the smaller size as long as I am credited and it is easily readable.
Changing or modifying the illustration without my permission and claiming it as yours.
Claim the art as yours.
Removing my watermark / credit.

★ Withholding the artist from any rights to publicly post the commissioned illustration will have corresponding additional charges.

★ The commissioner is required to credit the artist at all times (e.g., Ichinose, Ichino Ichinose) for any of the commissioned illustrations.

★ Filing a chargeback against the artist on PayPal REVOKES ALL RIGHTS of the client from the commissioned illustration. Furthermore, the artist will have rights to sell the copyrighted illustration to new buyers. In addition, the same client will be banned indefinitely for any transactions or communications with the artist.

★ Rude clients will also be treated similarly; indefinite ban and prohibited for any transaction and communication with the artist.

★ Clients who are untruthful will also be banned indefinitely.

Consequently, those clients who will be banned indefinitely will have their name and info posted publicly to notify other people, especially artists.
